TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s.23 application to vary an award

The AWU-FIME Amalgamated Union,
Tasmania Branch
(T.4864 of 1994)

QUARRYMENS AWARD

COMMISSIONER P A IMLACH

23 February 1994

Wage rates - State Wage Case December 1993 - arbitrated safety net adjustment

REASONS FOR DECISION

This was an application by The AWU-FIME Amalgamated Union, Tasmania Branch (the Union) for the $8 safety net adjustment, determined by a full bench of the Commission in the State Wage Case Decision1 dated 24 December 1993 to be implemented in the Quarrymens Award (the Award).

The Union in seeking the increase confirmed that the restructuring process had been applied to the Award and largely completed. There had also been discussions between the parties as to enterprise agreements, but with no results as yet.

The Tasmanian Chamber of Commerce and Industry Limited consented to the increase, but subject to the production of a satisfactory draft order by the Union.

An agreed draft order has been submitted in the interim period.

I am satisfied that the application fits the requirements of the Principles of the Commission and the Act. The Award will be amended as sought operative from the date of this decision.

An order will be issued in due course.
