s23 application for award or award variation

Australian Municipal, Administrative, Clerical and Services Union
(T4888 of 1994)

BARRISTERS AND SOLICITORS AWARD

PRESIDENT F. D. WESTWOOD

25 FEBRUARY 1994

Wage rates - State Wage Case December 1993 - arbitrated safety net adjustment

REASONS FOR DECISON

This application was for an increase in wage rates of $8 per week in accordance with the Arbitrated Safety Net Adjustment Principle determined in the State Wage Case Decision of 24 December 1994.

Mrs Dowd, for the Australian Municipal, Administrative, Clerical and Services Union, tendered a draft order setting out the new rates and providing in the supplementary payments provision that any increases were absorbable against over-award payments. An operative date, being the first full pay period commencing on or after the date of decision, was sought.

All parties present either supported Mrs Dowd's submissions or consented to the application.

The application conforms to the wage fixing principles, is in the form required by the Commission and does not offend the public interest provisions of the Industrial Relations Act 1984.

Accordingly, the application is approved with effect from the first full pay period commencing on or after today's date.

The order is attached.
