TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s.23 application to vary an award

Australian Municipal, Administrative, Clerical and Services Union
(T.4899 of 1994)

FUEL MERCHANTS AWARD

COMMISSIONER P A IMLACH

25 February 1994

Wage rates - State Wage Case December 1993 - arbitrated safety net adjustment

This was an application by the Australian Municipal, Administrative, Clerical and Services Union (the Union) for the $8 arbitrated safety net adjustment, determined by a full bench of the Commission in the State Wage decision dated 24 December 19931 to be implemented in the Fuel Merchants Award (the Award).

The Union produced a draft order and in seeking the increase advised that whilst there had been no restructuring of the Award in Tasmania, nor any moves towards enterprise agreements, such developments were taking place in the Federal jurisdiction and were expected to follow eventually in this jurisdiction.

The Tasmanian Chamber of Commerce and Industry Limited consented to the increase but requested that the decision be held until the draft order had been checked and agreed which it was forthwith.

I am satisfied that the application is not against the guidelines of the Commission, nor the provisions of the Act. The Award will be amended as sought, operative from the first full pay period from the date of this decision.

An order is attached.
