Award variation - 5th minimum rates adjustment REASONS FOR DECISION This application by the Health Services Union of Australia, Tasmania No 1 Branch (HSUA) was to vary the Welfare and Voluntary Agencies Award in respect of the 5th minimum rates adjustment (MRA). Mr Klein appearing for the HSUA submitted that the 5th and final MRA was in accordance with the schedule of adjustments submitted to the Commission in earlier proceedings. Mr Fitzgerald for the Tasmanian Chamber of Commerce and Industry Limited (TCCI) supported the HSUA application. He did however seek to reserve the opportunity to make submissions in respect of any service providers not able to meet the cost of the MRA adjustment. He indicated that it was most unlikely that opportunity would be required to be taken up but nevertheless the Commission should be cognisant that economic incapacity to pay submissions may have to be made. Having regard to the submissions of the parties I endorse the 5th MRA adjustment and the award will be varied to give effect to it operative from the first full pay period to commence on or after 29 June 1994. The order will follow. In the event that economic incapacity becomes an issue, there is recourse to make application to the Commission as provided by the Economics Incapacity Wage Fixing Principle.
