Award variation - superannuation exemption

REASONS FOR DECISION

In this matter the Tasmanian Chamber of Commerce and Industry Limited (TCCI) sought to include the MTAA Industry Superannuation Fund in the award. The background to this matter and the decision to endorse the request by the TCCI was outlined in my Reasons for Decision dated 7 June 1994.

At the date of issue of that Reasons for Decision, the TCCI had not provided the necessary proof that the employees of Century Motors, on whose behalf the exemption from the nominated award occupational superannuation scheme was sought, wished to alter their occupational superannuation arrangements. Neither was there the required documentation to demonstrate to the Commission that the MTAA Industry Superannuation Fund (the Fund) was a complying fund in accordance with the Occupational Superannuation Standards Act of 1987.

Appropriate documentation has now been presented to the Commission to enable it to discharge its obligations contained in Section 32(1B) of the Act. Accordingly, my order, operative from the first full pay period to commence on or after 7 June 1994 is attached.
