s23 application for an award or variation of an award

Association of Professional Engineers, Scientists and Managers
Australia

(T5081 of 1994)

PROFESSIONAL ENGINEERS AND SCIENTISTS (PRIVATE INDUSTRY) AWARD

PRESIDENT F D WESTWOOD

03 JUNE 1994

Award variation - Parties and Persons Bound Clause

REASONS FOR DECISION

This application by the Association of Professional Engineers, Scientists and Managers, Australia (APESMA), was to apply the arbitrated safety net adjustment of $8 per week to the Professional Engineers and Scientists (Private Industry) Award.

Mr Pyrke, for APESMA, submitted that the award was a minimum rates award and had been restructured to reflect appropriate wage re1ativities at all classification levels. The base rate and supplementary payment amounts had been established in the award; as was the recognition of absorption of supplementary payments in any over-award payments being made. In keeping with the annualised salary format of the award, the arbitrated safety net adjustment was expressed as an annual figure of $416. It was submitted therefore that the application was in accordance with the Wage Fixing Principles and was in the public interest. The date of hearing, 2 June 1994, was requested as the operative date.

For the Tasmanian Chamber of Commerce and Industry Limited, Mr Edwards advised the Commission of the employers' consent to the application and he agreed that 2 June 1994 was the appropriate operative date.

I accept and agree with the submissions of the parties and accordingly approve the application with effect from the first full pay period to commence on or after 2 June 1994.

The appropriate order will follow.
