Award variation - application for joinder - granted

REASONS FOR INTERIM DECISION

This was an application to amend the Prison Officers Award (the Award) made by the Minister for Public Sector Management, being the Minister administering the Tasmanian State Service Act 1984 (the Minister).

The application took the form of a consolidation of the Award and reflected quite a number of changes to the Award sought by the Minister under the Structural Efficiency Principle. Those changes had been put forward by the Minister during the hearing of matters T.2473 and T.2587 of 1990, the Prison Officers Special Case proceedings (the Special Case proceedings).

In this application the Minister sought to formalise his status as an applicant and to join it with the two matters mentioned above.

At the initial hearing of this application I advised the parties that I would join it with the two other matters as requested.

My reasons for joining this application were that:

  • the changes sought by the Minister were consistent with the Structural Efficiency Principle and had already been proposed by the Minister in the Special Case proceedings. They were, therefore, "on the table" for consideration by the Commission in those matters in any case and, moreover,

  • it has been well established in other Special Case proceedings before the Commission that consideration of Structural Efficiency Principle items is part of the process.

At the initial hearing of this application I decided that it would be joined with matters T.2473 and T.2587 of 1990 and, for the reasons given, I so order.
