REASONS FOR DECISION

These applications were lodged by the Australian Municipal, Administrative, Clerical and Services Union and The AWU-FIME Amalgamated Union, Tasmania Branch for the purpose of varying the Optical Industries Award to:

(a) Implement the second minimum rates adjustment;

(b) Modernise Clause 11 - Casual Employees;

(c) Modernise Clause 24 - Part-Time Employees;

(d) Modernise Clause 30 - Right of Entry;

(e) Vary Clause 31 - Saturday, Sunday and Holiday Work for Retail Services by decreasing penalty rates to reflect agreement reached arising out of the minimum rates adjustment negotiations;

(f) Amend Clause 33 - Savings to enable the penalty rate reduction in (e) above to be implemented.

All parties attending the hearing requested the Commission to vary the award in the manner outlined in the application.

All variations are consistent with the Wage Fixing Principles and the Public Interest requirements of the Act. Therefore, the award will be varied from the first full pay period to commence on or after 11 July 1994.

The Order [correction order] giving effect to this decision is attached.
