TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s.23 application for award or variation of award

Tasmanian Chamber of Commerce and Industry Limited
(T.5126 of 1994)

WELFARE AND VOLUNTARY AGENCIES AWARD

DEPUTY PRESIDENT ROBINSON

HOBART 3 October 1994

Award variation - Clause 2 - Scope - Consent matter - award varied - ffpp 29 September 1994

REASONS FOR DECISION

This matter concerns an application by the Tasmanian Chamber of Commerce and Industry Limited to vary the Welfare and Voluntary Agencies Award in respect of its scope.

The variation sought was to amend Clause 2(b) by adding the words "and Nursing Homes Award", so that the scope of this award excludes those now covered by that award.

The matter was one of consent and was consequent upon the creation of a separate award for nursing homes.

Given these circumstances I am satisfied that it would be consistent with public interest considerations to grant the application and accordingly the award will be varied to give effect to the amendment sought.

Date of Operation

This variation shall come into operation as from the first full pay period to commence on or after 29 September 1994.

Order

The order is to incorporate any consequential effects upon other parts of the award.

The orders giving effect to this decision will follow in due course and will be operative from the above date.
