Award variation - superannuation exemption

REASONS FOR DECISION

This application by the Tasmanian Chamber of Commerce and Industry Limited (TCCI) was for the inclusion in the award of the GIO Personal Superannuation Fund (the Fund) for employees of North City Cars and Commercials.

Mr Gates for the TCCI tendered Exhibit TCCI 1 which indicated that the Fund complied with the conditions set out in the Occupational Superannuation Standards Act 1987. Additionally he tendered statutory declarations which stated the desire of individual employees to direct occupational superannuation contributions made on their behalf to the Fund.

Accordingly as the requirements of Section 32 (1B) of the Act have been met to the satisfaction of the Commission, the exemption from the nominated award occupational superannuation is granted in favour of the GIO Personal Superannuation Fund.

The order, operative from the first full pay period to commence on or after the date of this decision is attached.
