TASMANIAN INDUSTRIAL COMMISSION Industrial Relations Act 1984 Police Association of Tasmania POLICE AWARD
Expense related allowances REASONS FOR DECISION This application by the Police Association of Tasmania sought to vary the Police Award to adjust expense-related allowances in accordance with the Consumer Price Index. For the Association, Mr Kadziolka tendered two exhibits detailing the method of calculating the percentage increase claimed which was 1.2% in respect of the twelve months to the end of June 1993 and 1.4% for the twelve months to 30 June 1994. Adjustments to the Motor Vehicle Expense Allowance (Clause 11.6) and the Overnight Expense Allowance (Clause 11.8) in accordance with previous practice, mirrored the General Conditions of Service Award. It was asserted that the application was in conformity with the wage fixing principles and did not offend the requirements of Section 36 of the Act relating to matters of public interest. Mr Kadziolka requested that the increases be available under the award with effect from the date of hearing. Mr Ogle informed the Commission that the application had the consent of the Commissioner of Police and submitted that the operative date should be the date upon which the decision was released. He confirmed that the calculations contained in the application were correct. Given the consent of the parties and since the wage fixing principles and public interest requirements of Section 36 are not offended, I informed the parties that the application was approved and that a formal decision to that effect would be released immediately. I confirm that verbal advice and determine that the award shall be varied in the manner sought with effect from 1 November 1994. An order to that effect is attached.
