Award variation - superannuation exemption

REASONS FOR DECISION

In this matter the Tasmanian Chamber of Commerce and Industry Limited (TCCI) made application to provide for the exemption of Supertrim Pty Ltd from the nominated superannuation fund in the Automotive Industries Award.

Mr Gates appearing for the TCCI submitted that the MTAA Industry Superannuation Fund (the Fund) is a complying fund in accordance with the conditions set out in the Occupational Superannuation Standards Act 1987. Exhibits TCCI1 and TCCI2 demonstrated that the fund was accorded complying status and that the Superannuation Commissioner of the Insurance and Superannuation Commission was satisfied in that regard. Statutory declarations executed by employees of Supertrim Pty Ltd confirmed that it is the wish of the employees concerned to have employer contributions diverted to the Fund.

In all of the circumstances, the Commission is satisfied that the requirements of Section 32(1B)(a) and (b) of the Act have been met and accordingly the exemption is granted. The award will be varied operative from the first full pay period to commence on or after 15 November 1994. The order is attached.
