Award variation - career start traineeships

REASONS FOR DECISION

This was an application by the Australian Liquor, Hospitality and Miscellaneous Workers Union - Tasmanian Branch (the Union) for amendments to be made to the Restaurant Keepers Award (the Award) to include a Career Start Trainees clause and for consequential amendments to be made including detailed prescriptions as to the wages rates to be paid to Career Start Trainees.

The Career Start Trainee system provides vocational training consistent with the needs of the industry and general skills appropriate to the workforce and to enhance the skill levels and future employment prospects of Career Start Trainees. This is achieved through various vocational education and training pathways, including a combination of work, education and structured training.

The parties advised the Commission that the amendments proposed for the Award reflected a settlement arrived at after much negotiation. The amendments also reflected a Career Start Traineeship system that was adapted to the work covered by the Award.

In advising its agreement to the amendments sought the TCCI indicated that two matters had not been completely finalised insofar as it was concerned and they maybe raised again at a later stage; they were:

  • the procedure to be followed in the case of the proposed termination of the employment of a Career Start Trainee; and

  • what exactly is involved in the recognition of prior learning.

It was submitted to the Commission that the endorsement of the agreed amendments would not be against the public interest nor the Principles of the Commission.

I accept the submissions of the parties: the Award will be amended as requested operative from the date of this decision.

An order is attached.
