TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s.23 application for award variation

Australian Municipal, Administrative, Clerical and Services Union
(T.5312 of 1994)

COMMISSIONER R J WATLING

HOBART, 9 January 1995

Award variation - wage rates - State Wage November 1989 - fourth and final minimum rates adjustment -Division B - clerical employees - deletion of obsolete Appendix - deletion of Minimum Wage - insertion of amount for annual leave loading - Principles satisfied - consent matter - application granted - award varied - operation ffpp 7 January 1995

REASONS FOR DECISION

This application was lodged by the Australian Municipal, Administrative, Clerical and Services Union. At the commencement of the hearing the applicant sought and was granted leave to amend the application. The amended application sought to vary the Printers Award in the following manner:

1. include the fourth and final minimum rates adjustment for employees falling within Clause 8, Division B, Clerical Employees;

2. remove from Clause 8, Division B, subclause 3 - Minimum Wage, and include the amount $257.40 in Clause 10 - Annual Leave, subclause (e) - Payment for Period of Leave; and

3. delete the Appendix from the award save that part of the Appendix which deals with Adult Entry Level for clerical employees which the applicant sought to have included in Clause 7 - Definitions.

All matters come before the Commission as one of consent.

Arising out of T.3923 of 1992, dated 10 December 1992, the first minimum rates adjustment was granted to clerical employees covered by this award. At that time it was agreed that four minimum rates adjustments would be phased in at 9 month intervals commencing on and from the first full pay period to commence on or after 7 October 1992.

This application seeks to include the final minimum rates adjustment in accordance with the previous mentioned agreement. It conforms with the Wage Fixing Principles and therefore is approved by the Commission.

The other issues being the subject of the application, are endorsed by the Commission as they only seek to tidy up existing award provisions and in the case of the Appendix delete an obsolete transition arrangement.

The Order giving effect to this decision is attached and will be operative from the first full pay period to commence on or after 7 January 1995.
