TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s23 application for an award or variation of an award

Australian Education Union
Tasmanian Branch

(T5317 of 1994)

GENERAL CONDITIONS OF SERVICE AWARD

PRESIDENT F D WESTWOOD

13 JANUARY 1995

Award variation - kilometreage rate

REASONS FOR DECISION

The Australian Education Union, Tasmanian Branch (AEU), sought a variation to Clause 8, Allowances, subclause P, Travelling, of the General Conditions of Service Award to reflect the changed cost of the official use of private motor vehicles since the award was last varied for this purpose in June 1993. (Matters T4402, T4402 and T4404 of 1993).

In accordance with the methodology determined by a Full Bench of the Commission in Matter T33 of 1985, dated 13 June 1985, it was submitted that having regard to the movement in the Hobart Private Motoring Sub Group Index over the period from March 1993 to September 1994, the kilometreage allowance should be increased by between .42 cents per kilometre and 1.38 cents per kilometre. It was submitted that since the issues of public interest and conformity with the wage fixing principles had been addressed by the Full Bench in 1985, and the Wage Fixing Principle dealing with expense related allowances was the same now as it was then, there was no impediment to the application being granted. An early operative date was requested.

The Minister for Public Sector Management concurred with the submissions of the applicant.

I accept the submission of the parties and for the reasons advanced by the applicant the award will be varied in the following manner:
