Award variation - casual rates and penalty rates - consent matter REASONS FOR DECISION This was an application pursuant to Section 23 of the Industrial Relation Act 1984 to amend the Restaurant Keepers Award (the Award) made by the Tasmanian Chamber of Commerce and Industry Ltd (the Chamber). In its submission the Chamber advised the Commission that the amendments sought were related to corrected anomalies in previous amendments. It should be noted that the previous amendments (specifically in matter T5190 of 1994) were a continuation of the Structural Efficiency Process within the Award and the same principle underlies the amendments sought in this matter. They had been agreed to by the Australian Liquor Hospitality and Miscellaneous Workers Union (the Union) as well as the operative date, the date of the hearing (6 June 1995). The Union confirmed its agreement to the proposed amendments and endorsed the submissions of the Chamber, including the proposed operative date. I endorse the agreement between the parties as to the application and the operative date. I am satisfied that the amendments proposed are within the guidelines of the Commission and are not against the public interest. An order is attached.
