Award variation - production employees classifications and wage rates

REASONS FOR DECISION

This matter concerned an application by The AWU-FIME Amalgamated Union, Tasmania Branch (AWU-FIME) for the variation of the Cement Makers Award. The proposed variation related to pay and other associated issues relevant to Central Control Room Operators and to Production Employees classified Grade 5 and Grade 6.

From the background provided by Mr Cooper appearing for the AWU-FIME and Mr Targett of the Tasmanian Chamber of Commerce and Industry Limited appearing for Goliath Portland Cement Co Ltd (Goliath), it was evident that the question of the determination of an appropriate rate of pay for Central Control Room Operators, who are classified as Production employees Grade 7, was left to one side pending the primary restructuring of the award by Mr Commissioner Imlach in matter T5394 of 1995. Therefore, and in accordance with the prior understandings of the parties, the matter was brought forward for finalisation in these proceedings.

In order for the Commission, as constituted in this matter, to gain an overview of the Central Control Room operations detailed inspections were undertaken which also extended to other parts of the plant. Those inspections were extremely helpful and were of considerable assistance in conciliating a consent settlement between the parties in these proceedings.

The agreement reached between the AWU-FIME and Goliath was predicated upon the acquisition of skills through the progression and the completion of the Certificate in Cement Manufacturing and the Advanced Certificate in Cement Manufacturing. This enabled the development of a career path for inclusion in the award by the addition of three new classification levels i.e. Grades 9, 10 and 11. In consequence opportunity was provided to recognise the long experience of employees in the Central Control Room and those in other supporting classifications through the deeming of experience equivalent to progression towards the qualifications referred to above.

The Commission supported the outcome achieved in these proceedings and congratulated the parties in developing a career structure relevant to the needs of Goliath and its employees. Accordingly the variation to the award as outlined in Exhibit W1 is endorsed operative from the first full pay period to commence on or after 30 June 1995.
