Award variation - first $8 safety net adjustment

REASONS FOR DECISION

In this matter the Australian Municipal, Administrative, Clerical and Services Union (AMACSU) sought the variation of the Community Services Award in respect of the first arbitrated safety net adjustment

By way of background a classification structure including wage rate relativities was established and phased in to be operative from the first full pay period to commence on or after 1 July 1995 and 1 January 19961. In that matter wage relativities were determined on the basis that the 100 per cent tradespersons wage rate was $417.20 a week2.

Accordingly, having regard to the impact generally of the first arbitrated safety net adjustment on wage rates in awards of the Commission, the parties agreed to the consent variation of the Community Services Award for that safety net adjustment to apply from the first full pay period to commence on or after 7 August 1995.

The Commission supports that position. As indicated in the proceedings an appropriate draft order should be submitted as soon as possible and no later than 31 August 1995. As well as that draft order the parties indicated they would also submit a draft order for the implementation of the classification structure and classification standards operative from the first full pay period to commence on or after 1 July 1995; as was determined in matter T4146 of 1992 et al.

Obviously the parties should prepare separate draft orders for each of the issues referred to above. That is the classification structure etc draft order should be identified under T4146 et al and the first arbitrated safety net adjustment under T5676 of 1995; which is the only subject matter before the Commission in this current matter.

The reason both matters have been discussed here is because the issues are intertwined in respect of the sequence of the orders that will be required to be issued in both matters in due course. Order
