TASMANIAN INDUSTRIAL COMMISSION

 Industrial Relations Act 1984
s.23 application for award or variation of award

The AWU-FIME Amalgamated Union
Tasmania Branch

(T.5679 of 1995)

SHEARING INDUSTRY AWARD

COMMISSIONER R K GOZZI

HOBART, 1 August 1995

Award variation - variation of superannuation clause

REASONS FOR DECISION

In the matter The AWU-FIME Amalgamated Union, Tasmania Branch sought the variation of the Shearing Industry Award to provide for occupational superannuation provisions which accorded with the relevant federal legislation.

The Commission is of the view that the requested variation to the award clearly spells out the obligation of employers to contribute, on behalf of employees, occupational superannuation quantums as specified by the Superannuation Guarantee Charge Act 1992.  The variation is consistent with Principle 10 - Superannuation of the Wage Fixing Principles and the September 1994 AIRC Superannuation Test Case Print L5100 at page 28.

Accordingly the variation is granted operative from the first full pay period to commence on or after 26 July 1995

The order is attached.
