s.23 application for award or variation of award

Health Services Union of Australia
Tasmania No 1 Branch

(T.5758 of 1995)

DISABILITY SERVICE PROVIDERS AWARD

DEPUTY PRESIDENT A ROBINSON

HOBART, 19 September 1995

Award variation - Clause 18 - Hours - Rostered Days Off - consent matter - award varied - ffpp 11 July 1995

REASONS FOR DECISION

This matter concerns an application by the Health Services Union of Australia Tasmania No 1 Branch to vary the Disability Service Providers Award in respect of Clause 18 - Hours - E Rostered Days Off, subclause (d). Presently the subclause contains an error in that it refers to 48 hours per week in lieu of 38.

The variation sought to correct the error is one of consent and the application is therefore granted. Thus clause 18 E(d) will be amended to read as follows:

"(d) The days off provided for herein shall be at the rate of 38 hours per week and by agreement may be cumulative, but not to exceed 4 days off successively."

Date of Operation

This variation shall come into operation as from the ffpp to commence on or after 11 July 1995. Order
