Industrial dispute - Pasminco Metals EZ Risdon - Cell Room - safety helmets and communication matters

REASONS FOR DECISION

This was a dispute hearing application made under Section 29 of the Industrial Relations Act 1984 by the Australian Mines and Metals Association Incorporated on behalf of Pasminco Metals Ez (the Company).

The Company was in dispute with The Australian Workers Union (the Union) over strike action taken by employees in the Cell Room of the Company's works at Risdon.

Having heard the parties the Commission recommends:

  • employees resume work as soon as possible;

  • the parties confer as to the issues in dispute;

  • any discussions between the parties will be "without prejudice" to final agreement; and

  • the parties need to clarify the status of the wearing of safety helmets, communication meetings and stopwork meetings and make the necessary arrangements or prepare the relevant documents to reflect their agreement, or seek the matters be relisted for hearing.

I draw the employees attention to the settlement of dispute procedures in the Electrolytic Zinc Award and remind them of their obligation to comply with the Award provisions.
