REASONS FOR DECISION

This was an application by the Health Services Union of Australia, Tasmania No.1 Branch (the Union) for variations to be made to the Tasmanian Ambulance Service Award (the Award).

The Union sought to vary the expense related allowances in the Award by amounts equivalent to movements in the appropriate Consumer Price Index of the Australian Bureau of Statistics for the period 1 April 1994 to 31 March 1995.

The allowances sought to be varied were provided in Clause 9 of the Award under the headings (e) Kilometreage Allowance, (f) Living Away From Home, (g) Meal Allowance and (j) Travelling Allowance.

The Union submitted that the application was in line with the Guidelines of the Commission, specifically the Allowances Principle at paragraph 9.1.11 and it was not against the public interest.

The Union also relied on a decision of the President of the Commission on 9 August 1995, in matter T.5695 of 1995, which granted on the same basis as this application, increases to expense related allowances provided in the General Conditions of Service Award; in the case of meal allowances and travelling allowances being exactly the same amounts as sought in this matter. In the case of kilometreage and living away from home allowances the basis of increase was the same as in the case mentioned, but, the amounts were peculiar to the Award.

The Minister for Public Sector Management (the Minister) advised the Commission of his agreement to the increases sought and confirmed that the application was in accordance with the Guidelines of the Commission and was not against the public interest.

Both parties agreed that the date of operation be the first full pay period on or after the date of the decision in this matter.

I accept the submissions of the parties and endorse the application. The date of operation will be the first full pay period on or after 23 October 1995.

An order is attached.
