Expense related allowances

REASONS FOR DECISION

This application by the Police Association of Tasmania sought to vary the Police Award to adjust expense-related allowances in accordance with the Consumer Price Index.

For the Association, Mr Kadziolka tendered an exhibit detailing the method of calculating the percentage increase claimed of 3.9% which, it was submitted, was the CPI change for the 12 month period from the March quarter 1994 to the March quarter 1995.

This adjustment was to be applied to all expense related allowances in the award apart from the Motor Vehicle Expense Allowance (Clause 11.6) and the Overnight Expense Allowance (Clause 11.8) which, in accordance with previous practice, were to be varied to mirror the General Conditions of Service Award.

It was asserted that the application was in conformity with the current wage fixing principles, specifically Principle 9.1.1, and did not offend the requirements of Section 36 of the Act relating to matters of public interest.

Mr Kadziolka requested that the increases be available under the award with effect from the date of decision.

Sergeant Shaw informed the Commission that the application had the consent of the Commissioner of Police and submitted that the operative date should be the date upon which the decision was released. He confirmed that the calculations contained in the application were correct.

Given the consent of the parties and since the wage fixing principles and public interest requirements of Section 36 are not offended, the application is approved. The award will be varied in the manner sought with effect from 13 October 1995.

The appropriate order is attached.
