Award variation - exemption from nominated superannuation fund

REASONS FOR DECISION

This application by the Australian Municipal, Administrative, Clerical and Services Union was for the inclusion in the Clerical and Administrative Employees (Private Sector) Award of the AMP Masterplan for employees of the Australian Municipal, Administrative, Clerical and Services Union, Tasmanian Branch, Administrative and Clerical Division.

Mrs Dowd, representing the applicant, tendered Exhibit ASU.1 which indicated that the chosen fund, the AMP MasterPlan, complied with the conditions set out in the Superannuation Entities (Taxation) Act 1987. Additionally she tendered statutory declarations which stated the desire of the individual employees to direct occupational superannuation contributions made on their behalf to the AMP MasterPlan in lieu of the award nominated superannuation fund.

Ms Thomas for the Tasmanian Chamber of Commerce and Industry Limited, supported the submissions made by Mrs Dowd.

Accordingly as the requirements of Section 32(1B) of the Act have been met to the satisfaction of the Commission, the exemption from making contributions into the award nominated occupational superannuation fund is granted in favour of the AMP MasterPlan.

The relevant order, operative from 15 December 1995, is attached.
