REASONS FOR DECISION

Application T5774 of 1995 by the Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union seeks to restructure the Shipbuilders Award consistent with the wage fixing principles of the Commission. The matter, subject of this decision, was one of a number of structural efficiency variations to the award being considered by the parties as a consequence of this application, some of which are yet to be heard and determined.

This part of application T5774 sought to delete Division B, the clerical division, and to restructure the award with a single classification scale in lieu of the two currently existing.

Mr Baker, for the applicant, explained that there were very few clerical employees engaged under the award and that the Clerical and Administrative Employees (Private Sector) Award would be relevant for those employees.

Ms Dowd, representing the Australian Municipal, Administrative, Clerical and Services Union, tendered an agreed draft setting out the variations sought. Mr Edwards, for the Tasmanian Chamber of Commerce and Industry Limited confirmed the agreement of the Chamber to the deletion of clerical classifications from the Shipbuilders Award, given the small number of clerical employees covered. He said that the application was consistent with the structural efficiency principle of the Commission.

It was agreed by the parties that consequential amendments should be made to the draft order by deleting from the award all references to clerical employees. An operative date of the first full pay period commencing on or after 14 November 1995 was sought.

I am satisfied that the application is in accordance with the structural efficiency principles of the Commission and all reference to clerical employees in the award will be deleted.

The order  [correction order] is attached operative from the beginning of the first full pay period commencing on or after 14 November 1995.

The hearing of Matter T5774 will continue for the purpose of completing the restructuring of the award.
