REASONS FOR DECISION

This was an application for an amendment to the Cement Makers Award made by The Australian Workers' Union, Tasmania Branch (the AWU).

The application sought (1) to have the name of the Cement Makers Award changed to the Goliath Cement Enterprise Award and (2) to vary the Scope Clause of the Cement Makers Award to delete reference to asbestos products.

The Commission was reminded at the hearing that the Cement Makers Award has been in existence for a long time and pre-dated the Commission. The two changes sought reflected the intention of the parties to avail of Section 33 (1) (b) of the Act allowing in comparatively recent times for the enterprise awards to be made.

It was pointed out that there was no other cement maker operating in Tasmania.

The parties who were agreed on the application, submitted that there was no impediment to its approval because it was not inconsistent with the Principles of the Commission and it did not offend against public interest.

I accept the submissions of the parties: the Cement Makers Award will be amended as requested operative from 5 December 1995.

An order is attached.
