s.23 application for award or variation of award

National Union of Workers, Tasmanian Branch
(T5979 of 1995)

FIBREGLASS AND PLASTICS AWARD

COMMISSIONER P A IMLACH

1 April 1996

Award variation - increase tool allowance - consent matter - application granted - operative 22 Feb 96

REASONS FOR DECISION

This was an application for a variation to the Fibreglass and Plastics Award (the Award) to provide for an increase in the amount of the tool allowance specified in clause 9(a) of the Award - from $8.90 to $10.30 per week.

The application was made by the National Union of Workers, Tasmanian Branch (the Union).

At the hearing the Union, with the indispensable and able assistance of the Tasmanian Chamber of Commerce and Industry Limited (the Chamber), outlined the formula used as a precedent in establishing the amount of the increase and the relevant changes in the all Capitals Consumer Price Index of the Australian Bureau of Statistics up to the end of the December 1995 quarter.

The Union submitted that the increase sought was in accordance, in particular, with the Allowance Principle of the Guidelines of the Commission and was not against the public interest.

The date of operation sought was the first full pay period on or after 22 February 1996.

The Chamber confirmed the submissions of the Union including the operative date sought and consented to the application.

Decision

I am satisfied that this application meets the requirements of the Guidelines of the Commission and is not against the public interest. The application is approved.

The Award will be amended as sought and will operate from the first full pay period on or after 22 February 1996.

An order is attached.
