REASONS FOR DECISION

This application was lodged by the National Union of Workers, Tasmanian Branch (the applicant) for the purpose of varying the Wholesale Trades Award in relation to Clause 11 - Commercial Travellers, subclauses (c) and (d) and Clause 17 - Meal Hours and Tea Money.

At the commencement of the hearing the applicant sought and was granted leave to amend the application by withdrawing the claim in respect of Clause 17 - Meal Hours and Tea Money.

The amended application sought to vary the award by increasing the amounts in subclause (c) - Locomotion by 35.7%, being the upward movement in the Consumer Price Index for Hobart - transport component - from and including the March quarter 1987 up to and including the June quarter 1995. Subclause (d) - Special Allowance contained in that clause was also varied by 1.88% to reflect the second safety net adjustment.

The Commission was informed that all matters, being the subject of the amended application, were consented to by the parties.

I have considered the submissions of the parties and arrived at the conclusion that the variations, as outlined in the draft order provided at the hearing, are consistent with the Wage Fixing Principles and therefore the award will be varied in the manner sought.

The Order giving effect to this decision is attached and will be operative from the beginning of the first full pay period to commence on or after 5 February 1996.
