REASONS FOR DECISION

This application by the Australian Workers' Union, Tasmania Branch, was to vary the Shellfish Industry by the insertion of a new clause to cater for the employment of career start trainees.

Mr Cooper, representing the union, informed the Commission that currently twenty people were undertaking traineeships in sea food processing, and that a number of people were ready, willing and able to participate in the shellfish industry.

A working party had been developing the training program for some time but had overlooked the need for a provision to be inserted in the award to accommodate the proposal for the shellfish industry. Because of the flexibility in the training program, credits were available to recognise prior learning which meant that the off-the-job training component could vary between 8 and 16 weeks. Since the rate of pay was averaged to take account of time on the job, a formula was provided in the new clause setting out how the weekly wage rate was to be calculated. In all other respects the clause was similar to other Career Start Traineeship award provisions.

Mr Edwards, for the Tasmanian Chamber of Commerce and Industry Limited, indicated the employers' consent to the application and strongly supported the incorporation of a traineeship clause in the award, adding that the industry provided an ideal opportunity for the creation of training opportunities. Improved training would also enhance the industry and advance it at both national and international levels.

I am satisfied that the proposed order is in the public interest and I endorse the views of both parties. Accordingly the application is approved, effective from the date proposed by the parties, i.e. the first full pay period on or after 11 March 1996.

The relevant order (correction order) is attached.
