REASONS FOR DECISION

This was an application made under Section 23 of the Act for a variation to be made to the Goliath Cement Enterprise Award (the Enterprise Award).

The application was made by the Tasmanian Chamber of Commerce and Industry Limited (the Chamber).

In essence the variation sought wage increases for all employees in two instalments in exchange for which further efficiencies were to be implemented at the Goliath Cement Works, Railton. The efficiencies were elaborated in exhibits produced at the hearing by the Chamber.

The agreed wage increases were 3 percent from the first full pay period on or after 1 December 1995, 2 percent also from the first full pay period on or after 1 December 1995, but, the latter was not payable until after the approval of this application by the Commission. As part of this process Clause 9 - Additional (Excess) Payments, in the Enterprise Award were incorporated into the wages in Clause 8 - Wage Rates.

There were also a small number of other variations to the Enterprise Award, agreed by the parties, but, they were primarily consequential amendments.

The Chamber submitted that the variation sought complied with the various requirements of the Act and the Principles of the Commission, in particular, the Enterprise Bargaining Principle which the Chamber canvassed in detail.

The unions present at the hearing and party to the Enterprise Award all indicated their agreement to the terms of the application and their support for the submissions of the Chamber.

I am satisfied that the variation sought in this application is not against the requirements of the Act, the Guidelines of the Commission nor the public interest.

The application is approved and an order reflecting this decision is attached.
