RUBBER TRADES AWARD

REASONS FOR DECISION

These four applications, which were joined at the outset, were for the third $8.00 Safety Net Adjustment (SNA) to be applied to the Rubber Trades Award (the Award) in accordance with the terms of the State Wage Case decision1 of a full bench of the Commission on 24 July 1996 (the July 1996 State Wage Case decision).

The applications were made by The Australian Workers' Union, Tasmania Branch (the AWU), the National Union of Workers, Tasmanian Branch (the NUW), the Australian Municipal, Administrative, Clerical and Services Union (the AMACSU) and the Shop, Distributive and Allied Employees Association, Tasmanian Branch (the SDA).

In seeking the $8.00 increase the AWU advised the Commission that 12 months had elapsed since the second SNA2 had been implemented in the Award. The AWU also advised that agreement had been reached between all the parties as to the increase and gave a commitment to take part in a review of the Award as required in paragraph 7.3.2.3 of the Guidelines of the Commission set down in the July 1996 State Wage Case decision.

The AWU submitted that the applications complied with the Guidelines of the Commission and their acceptance was not against the public interest. The AWU requested that the claimed amendment operate from the first full pay period to commence on or after 2 September 1996.

The NUW, the AMACSU and the SDA all supported the submissions of the AWU and confirmed their agreement to the terms of the draft order and the operative date. They each gave the commitment to take part in a review of the Award as required in paragraph 7.3.2.3 of the Guidelines of the Commission.

The Tasmanian Chamber of Commerce and Industry Limited (the TCCI) acknowledged that the applications complied with all the requirements of the Guidelines of the Commission and the Act and confirmed its agreement to the proposed amendments including the date of operation.

The TCCI noted that all the unions, party to the Award concerned, had given the required commitment including the Transport Workers' Union of Australia, Tasmanian Branch (the TWU) which had given prior written commitment.

Relevant allowances were not sought to be adjusted by this application.

I am satisfied that the requirements of the Guidelines of the Commission and the Act have been met in these matters: the applications are granted and an order, operative from the first full pay period to commence on or after 2 September 1996 is attached.
