REASONS FOR DECISION

This was an application by the Australian Municipal, Administrative, Clerical and Services Union (the Union) for the third $8.00 Safety Net Adjustment (SNA) to be applied to the Estate Agents Award (the Award) in accordance with the terms of the State Wage Case decision1 of a full bench of the Commission on 24 July 1996 (the July 1996 State Wage Case decision). The application also included an increase of $24.00 (3 x $8.00 SNA's) to the minimum payment for the annual leave loading prescribed in Clause 9(f)(ii) of the Award.

In seeking the third SNA the Union advised the Commission that in accordance with the relevant Guidelines of the Commission, more than 12 months had elapsed since the second SNA2 had been implemented in the Award.

A draft order was produced and the Union gave a commitment to take part in a review of the Award as required in paragraph 7.3.2.3 of the Guidelines set down in the July 1996 State Wage Case decision.

The Union requested that the amendments operate from the first full pay period to commence on or after 2 September 1996.

The Tasmanian Chamber of Commerce and Industry Limited acknowledged that the Guidelines of the Commission had been complied with and confirmed its agreement to the proposed amendments as set out in the draft order including the date of operation.

Relevant allowances were not sought to be adjusted by this application.

I am satisfied that the requirements of the Guidelines of the Commission and the Act have been met in this matter: the application is granted and an order operative from the first full pay period to commence on or after 2 September 1996 is attached.
