REASONS FOR DECISION

This application, lodged by the Minister for Public Sector Administration (the applicant), sought to rescind the Pharmacists Award.

Ms A Watt, for the applicant, submitted that no employee was classified under the Pharmacists Award as a result of the making of the Community and Health Services Award. She said, given the foregoing, the award was now superfluous.

Section 32(7A) of the Act states -

"The Commission may, of its own motion or upon application by an organization and after consultation with such organizations as it considers appropriate, by notice in the Gazette, rescind an award it considers no longer serves any useful purpose."

At the request of the applicant and The Community & Public Sector Union (State Public Services Federation Tasmania), being the only other party to the award, I hereby determine that the Pharmacists Award be rescinded as an award of the Tasmanian Industrial Commission on and from 27 September 1996, and I so Order.
