REASONS FOR DECISION

This was an application by the Australian Liquor, Hospitality and Miscellaneous Workers Union (Tasmanian Branch) (the Union) for the Licensed Clubs Award (the Award) to be varied by the implementation of the fourth Minimum Rates Adjustment (MRA).

Under the structural efficiency principle of the Commission the Union sought the fourth MRA increase for the Award and produced a draft order reflecting the variations sought.

The MRA process was commenced in the Award through matter T5189 of 1994. This application reflected the final step in the MRA process for the Award.

The Union submitted that the application was within the Guidelines of the Commission and its approval was not against the public interest. The Union also requested that the fourth MRA increase be made to commence from the first full pay period on or after 1 November 1996.

The Tasmanian Chamber of Commerce and Industry (the Chamber) advised its agreement to the application and the draft order and confirmed that the amounts claimed were those agreed to in the original schedule for implementation. The Chamber submitted also that the granting of the application was within the Guidelines of the Commission and was not against the public interest.

I accept the submissions of the parties. The Award will be amended as agreed to operate from the first full pay period to commence on or after 1 November 1996.
