Award - rescind - operative 25 November 1996 REASONS FOR DECISION This application, lodged by the Australian Liquor, Hospitality and Miscellaneous Workers Union - Tasmanian Branch (the applicant), sought to rescind the Bakers Award. Mr D O'Byrne, for the applicant, presented a submission to the Commission which, simply stated, identified that employees who fell within the scope of the Bakers Award were now covered by the new Baking Industry Award. This new award resulted from the restructuring program for the Bakers Award. On and from 25 November 1996 all employees and employers falling within the scope of the Bakers Award will be covered by the new Baking Industry Award and, as a result, the Bakers Award will be superfluous. All parties present at the hearing endorsed the submission presented by Mr O'Byrne. Section 32(7A) of the Act states - "The Commission may, of its own motion or upon application by an organization and after consultation with such organizations as it considers appropriate, by notice in the Gazette, rescind an award it considers no longer serves any useful purpose." At the request of the applicant and all the parties to the award, I hereby determine that the Bakers Award be rescinded as an award of the Tasmanian Industrial Commission on and from the 25 November 1996, and I so Order. The Order giving effect to this decision is attached.
