Rescission of award - operative ffpp 18 February 1997 REASONS FOR DECISION This application, lodged by The Australasian Meat Industry Employees Union, Tasmanian Branch, sought to rescind the Abattoirs Award under s.32(7A) of the Act. The matter was relisted for hearing on Tuesday, 18 February 1997. Mr J Swallow, for the applicant, presented a submission to the Commission which, simply stated, identified that employees who fell within the scope of the Abattoirs Award were, from the first full pay period to commence on or after the 18 February 1997, covered by the new Meat Processing Industry Award, thus resulting in the Abattoirs Award being superfluous. All parties present at the hearing endorsed the submission presented by Mr Swallow. Section 32(7A) of the Act states - "The Commission may, of its own motion or upon application by an organization and after consultation with such organizations as it considers appropriate, by notice in the Gazette, rescind an award it considers no longer serves any useful purpose." At the request of the applicant and all the parties to the award, I hereby determine that the Abattoirs Award be rescinded as an award of the Tasmanian Industrial Commission from the first full pay period to commence on or after the 18 February 1997, and I so Order. The Order giving effect to this decision is attached.
