REASONS FOR DECISION

These proceedings concern two applications lodged by the Minister for Public Sector Administration (the Minister) to vary, respectively, the Inland Fisheries Commission Award1 and the Operational Employees Award2. The respondent employee organisation is The Community and Public Sector Union (State Public Services Federation Tasmania) (CPSU). At the Minister's request, there being no objection from CPSU, I heard the matters together.

Ms A Watt, appearing for the Minister, submitted that the applications seek to give effect to decisions of Full Benches of this Commission in matters T61433 and T6502 and Others4 concerning review of the awards in question regarding, among other things, consistent award formatting and introduction of plain English terminology. Ms Watt said that for purposes of achieving uniformity with the Commission's decision in public sector awards dealt with in T6502 and Others, the Minister seeks an operative date of 7 March 1996.

Ms Watt contended that, in the circumstances described, the proposed variations comply with the current Wage Fixing Principles and contain no elements that are inconsistent with the more general public interest requirements of Section 36 of the Industrial Relations Act 1984.

Mr R Clegg, appearing for CPSU, consented to the proposed variations and the nominated operative date.

Having heard the parties' submissions I am satisfied that the applications comply with the Wage Fixing Principles and contain no matters that are contrary to the more general public interest requirements of Section 36 of the Act. Accordingly, I approve the applications and vary the awards in terms of the amended draft orders submitted during the hearing. The Commission's Orders, which will issue in due course, take effect from 7 March 1996.
