REASONS FOR DECISION

This amended application, lodged by the Health Services Union of Australia, Tasmania No. 1 Branch (the applicant), was for the purpose of varying the Disability Service Providers Award to insert a subclause to provide for carer's leave, thus giving effect to a Full Bench decision arising out of applications T6296 of 1996 and T6441 of 1996.

The applicant produced an agreed draft Order, which varied from the draft model clause arising out of the previously mentioned Full Bench decision, to the extent that it was made consistent with the Disability Service Providers Award and provided carer's leave for part-time employees.

Mr Paterson, of the Australian Municipal, Administrative, Clerical and Services Union, supported the application.

Ms Thomas, of the Tasmanian Chamber of Commerce and Industry Limited, advised the Commission that following discussions with the applicant, the organisation she represented consented to the variations in the form outlined in the amended draft Order. She said the application was consistent with the Wage Fixing Principles, the public interest and the decision arising out of the Full Bench dealing with the subject matter of this application.

I accept the submissions of the parties and grant the application as it is consistent with previous decisions of the Commission, especially those arising out of applications T6296 of 1996 and T6441 of 1996.

The Order giving effect to this decision is attached and will be operative from the first full pay period to commence on or after 17 April 1997.
