REASONS FOR DECISION

The applicant in these proceedings, the Australian Municipal, Administrative, Clerical and Services Union (ASU) seeks to vary the Public Vehicles Award to reflect the recent decision of a Full Bench of this Commission regarding Carer's Leave,1 together with associated facilitative provisions.

When the matter came on for hearing on Thursday, 24 April 1997 Mr I Paterson appeared for ASU and Ms J Thomas appeared for the Tasmanian Chamber of Commerce and Industry Limited (TCCI). The other employee organisations with an award interest in this matter (The Australian Workers' Union, Tasmania Branch and the Transport Workers' Union of Australia, Tasmanian Branch) did not appear, although notified of the proceedings.

Mr Paterson submitted that the proposed variation differs from the Full Bench model clause only to the extent that it provides for the particular circumstances of the relevant award and includes provision for part-time employees. He went on to explain that the parties could not agree on provisions for casual employees, which remain a matter for future negotiation.

Mr Paterson requested me to vary the award in terms of the draft order as tendered and amended at the hearing, with effect from beginning of the first full pay period to commence on or after the date of this hearing.

Ms J Thomas informed me that TCCI consents to the amended draft order as submitted by ASU and the proposed date of operation.

Having heard the parties' submissions I am satisfied that the proposed variation complies with the Wage Fixing Principles and contains no matters that are contrary to the public interest requirements of Section 36 of the Industrial Relations Act 1984. In those circumstances I grant the application and vary the award in terms of the amended draft order.

My Order, [correction order] which accompanies these Reasons for Decision, will take effect from beginning of the first full pay period to commence on or after 24 April 1997.
