Award variation - meal allowance - increase to reflect CPI movements - applications granted - operative ffpp 15 Feb 97

REASONS FOR DECISION

These applications by the Australian Municipal, Administrative, Clerical and Services Union sought to vary the rate for meal allowance provided in nominated clauses of the Estate Agents Award and the Totalizator Agency Award by increasing the allowance to reflect the Australian Bureau of Statistics Consumer Price Index (CPI) movement in the appropriate category of `meals out and take away foods' for the June quarter 1995 up to and including the June quarter 1996.

The union sought to increase the meal allowance specified in Clause 31 - Travelling Time, Allowances and Board of the Estate Agents Award, and Clause 17 - Rest Pauses and Meal Breaks of the Totalizator Agency Award, by 2.2 percent from $9.25 to $9.45, an increase of 20 cents.

Mr Paterson, representing the applicant union, submitted that these variations had been omitted from applications dealing with the same awards when the Commission dealt with consent applications in T6582 and T6597 of 19961. He believed the applications were consistent with the wage fixing principles of the Commission and requested that the operative date of variation be that which was decided in those matters, that is the first full pay period commencing on or after 15 February 1997.

Mr Watson, representing the Tasmanian Chamber of Commerce and Industry Limited and the Totalizator Agency Board, agreed that the applications were consent matters and said that the variations would not offend the public interest and were consistent with the Commission's wage fixing principles.

I accept the submissions of the parties.

The applications are approved and the awards will be varied as requested by the applicant. The orders will take effect from the first full pay period to commence on or after 15 February 1997. The orders are attached.
