Award variation - salaries clause - qualifications - consent matter - application granted - operative 7 March 1996 REASONS FOR DECISION This amended application, lodged by the Minister for Public Sector Administration, pursuant to s.23 of the Act, was to vary the Professional Employees Award by deleting Clause 8 - Salaries, subclause (c) Qualifications, and inserting a new subclause (c) as outlined in the application (Exhibit W.1). On 4 April 1997 the Commission, as currently constituted, finalised the making of the Professional Employees Award and an agreed draft Order was issued at that time. This application seeks to amend the previously mentioned subclause as, in the words of Ms Watt, for the Minister for Public Sector Administration, "it did not reflect the intention of the parties". The application was supported by Ms S Strugnell, for The Community and Public Sector Union (State Public Services Federation Tasmania) and Mr D Pyrke for The Association of Professional Engineers, Scientists and Managers, Australia. I am satisfied that the award should be varied in the manner sought by the parties as it accurately reflects their intention and was something that should have been included in the agreed draft orders presented to the Commission arising out of application T6472 of 19961. The Order giving effect to this decision is attached and will be operative on and from 7 March 1996.
