Award variation - Division B - carer's leave - consent matter - application granted - operative 7 March 1997

REASONS FOR DECISION

This was an application under Section 23 of the Industrial Relations Act 1984 for a variation to be made to the Estate Agents Award (the Award). The application was made by the Australian Municipal, Administrative, Clerical and Services Union (the Union).

At the hearing the Union pointed out to the Commission that, by an omission in T6789 of 1997 employees covered by Division B did not have access to Carer's Leave as granted in the Full Bench decision in matters T6296 of 1996 and T6441 of 1996 which applied to all employees subject only to correct application.

The Union requested that an appropriate reference be inserted in Clause 34 - General Conditions of Division B of the Award as outlined in the application. The Union submitted that the variation was not against the Wage Fixing Guidelines of the Commission nor the public interest. The Union also requested that for consistency the variation be made to operate from the first full pay period to commence on or after 7 March 1997.

The Tasmanian Chamber of Commerce and Industry advised its consent to the application including the date of operation, and also submitted that its approval would not be against the Wage Fixing Principles of the Commission nor the public interest.

I accept the submissions of the parties. The Award will be varied as requested, operative from first full pay period to commence on or after 7 March 1997.
