Award variation - wages rates operative date - consent matter - application granted - award varied - operative 30 July 1997.

REASONS FOR DECISION

This application, lodged by the Australian Municipal, Administrative, Clerical and Services Union (the applicant), was for the purpose of varying the Community Services Award by deleting subclause (b) from Clause 8 - Wage Rates of the Award.

Mr I Paterson, for the applicant, advised the Commission that as a result of the granting of the $10.00 Safety Net Adjustment increase, arising out of a decision1 of the Full Bench in the State Wage Case of 4 July 1997, it had been drawn to the attention of his organisation that subclause (b) of Clause 8 - Wage Rates was no longer relevant and had the potential to create confusion in relation to the operative date of the award.

Mr Paterson said the obsolete provision was originally placed in Clause 8 of the award to indicate the operative date of a specific clause. He said that the application for the removal of subclause (b) from Clause 8 - Wage Rates was a consent matter, it was consistent with the past and current Wage Fixing Principles and was consistent with the public interest.

Mr M Watson, for the Tasmanian Chamber of Commerce and Industry Limited, confirmed that the matter was a tidying up exercise and agreed with the submission of Mr Paterson.

Given the foregoing, I hereby determine that the Community Services Award will be varied in the manner sought and the operative date will be on and from 30 July 1997. Order.
