Records of Employment - employer failed to comply with section 75(5) notice to produce employment records - section 75(7E) order sought on employer - order issued

REASONS FOR FURTHER DECISION

AND CORRECTION ORDER

On 11 September 1997, in matter T7167 of 1997, I made the following order:

"Order

PURSUANT TO section 75(7A) of the Industrial Relations Act 1984 I HEREBY ORDER AND REQUIRE Tasmanian Redline Coaches Pty Ltd (ACN 009 499 094), 18 Charles Street, Launceston, Tasmania to forward to the Chief Executive, Workplace Standards Authority, Henty House, 1 Civic Square, Launceston, Tasmania, by not later than 5:00pm on Friday, 19 September 1997, a true copy of the records specified below relating to the employment of Stephen John Oakley at Tasmanian Redline Coaches Pty Ltd, 9 Edward Street, Devonport, Tasmania:

1. Time sheets for the period 6 April 1996 to 4 April 1997; and

2. Information regarding gross wages paid 6 April 1996 to 23 November 1996."

By letter of 8 October the State Manager, Advocacy and Case Management, Workplace Standards Authority informed me that:

"In relation to your decision of the 11 September 1997 and your subsequent order it appears an error has occurred in the printing where it states:-

'Pursuant to Section 75(7A) .....'

I believe it should read:-

'Pursuant to Section 75(7E)'.

If you are in agreement with my reading of the Act could you please issue a correction order."

After perusing the letter and my order I am satisfied that an error has occurred as asserted. Accordingly, pursuant to the provisions of section 19(2)(a) of the Act I now make the following order:

Correction Order

PURSUANT TO the powers conferred on the Commission by section 19(2)(a) of the Industrial Relations Act 1984 my order of 11 September 1997, made in connection with matter T7167 of 1997, is corrected as follows:

By deleting the word, numerals and symbols "section 75(7A)" and inserting in lieu "section 75(7E)".
