REASONS FOR DECISION

This was an application made under Section 23(1) of the Industrial Relations Act 1984 by the Australian Liquor, Hospitality and Miscellaneous Workers Union - Tasmanian Branch (the Union) seeking a variation to the Restaurant Keepers Award (the Award).

At the hearing the Union, speaking to the application which included a draft amendment, pointed out to the Commission that nomination of the award had been omitted by mistake when the Supported Wage System application was made to a Full Bench of the Commission in matter T5985 of 1995. The model clause prescribed in the decision granting that previous application was the guide for the draft in this application.

The Union also produced correspondence from the Shop, Distributive and Allied Employees Association, Tasmanian Branch and the Australian Municipal, Administrative, Clerical and Services Union indicating their support for the Union's application.

The Union submitted that the granting of the application was not against the public interest nor the Principles of the Commission.

The Tasmanian Chamber of Commerce and Industry advised its consent to the application and also submitted that its approval was not against the public interest nor the Principles of the Commission.

It was agreed that the variation should commence from the first full pay period on or after 6 October 1997.

I accept the submissions of the parties. The Award will be varied as proposed and the variation will commence from the first full pay period to commence on or after 6 October 1997.

An order is attached.
