REASONS FOR DECISION

The application before the Commission in this matter, lodged by the Australian Municipal, Administrative, Clerical and Services Union, seeks to move the Commission to vary the Entertainment Award for the purpose of including the 2nd and 3rd $8 Safety Net Adjustments.

At the hearing of the application Mr I Paterson appeared for the applicant Union, Mr D Shelverton appeared for the Media, Entertainment and Arts Alliance, Tasmania Branch and the Musicians' Union of Australia, Hobart Branch and Mr R Brown appeared for the Tasmanian Chamber of Commerce and Industry Limited.

The matter proceeded by consent, all parties submitting that the proposed variations fulfilled all the requirements of the current Wage Fixing Principles, in particular Clause 7.3 of those Principles, ie it being an application to increase wage rates in respect of a period commencing on or after 14 September 1997. In addition, the parties said, the application contains no elements contrary to the general public interest provisions of Section 36 of the Industrial Relations Act 1984.

During the course of the hearing it became apparent to me that, in relation to the particular award, there are a number of matters that require attention; for example, to identify two such issues, minimum rates adjustments and persons and parties bound. I informed the parties that I expect them to bring the award up to date during the course of the Award Review Process contemplated by Clause 16 of the Wage Fixing Principles.

Returning to the present application I am satisfied that it complies with the Wage Fixing Principles and is not contrary to the general public interest provisions of Section 36 of the Act. In the circumstances I am prepared to vary the Award in the manner sought by the application. My Order in that regard, which accompanies this decision, takes effect from beginning of the first full pay period commencing on or after 20 November 1997.
