REASONS FOR FURTHER DECISION

This application was lodged by the Australian Liquor, Hospitality and Miscellaneous Workers Union - Tasmanian Branch (the Union) pursuant to Section 29(1) of the Industrial Relations Act 1984 (the Act) for a hearing in relation to a dispute with Swansea Cottages (the employer).

The dispute related to the alleged breach of the Hotels, Resorts, Hospitality and Motels Award affecting the employment of a former employee.

The matter was heard before the Commission on 23 September 1997 in Swansea following which a decision was issued on 2 February 1998. The file was left open for the parties to settle payment.

The matter was relisted for 20 August 1998. However, correspondence from the Union, dated 19 August 1998, advised the Commission that:

    "We wish to withdraw this application ... ."

Given the foregoing and pursuant to Section 21(2)(c)(iv) of the Act the file is closed.
