Award variation - Sea Victualling Allowance and Sea Going Allowance - approved - operative ffpp 11 Mar 98 REASONS FOR DECISION This was an application by The Community and Public Sector Union (State Public Services Federation Tasmania) (the Union) pursuant to Section 23 of the Industrial Relations Act 1984 (the Act) for a variation to be made to the Sea Fisheries Award (the Award). The application sought to vary the Sea Victualling and the Sea Going Allowances specified in Clause 9 of the Award in accordance with the guidelines laid down by a Full Bench of the Commission concerning expense related allowances in matter T833 of 1987. In that decision the Full Bench confirmed that increases such as those applied for in this case, were available on the terms of the allowances principle then operating: "Existing allowances which constitute a reimbursement of expenses incurred may be adjusted from time-to-time where appropriate to reflect the relevant changes in the level of such expenses." This prescription is still extant and unchanged. The 1.3 percentage increase sought related to the change in the relevant Consumer Price Index for the period March 1996 to March 1997. The Union submitted that the application complied with the current Principles of the Commission and its approval was in the public interest. The Union requested that the allowance increase be made effective from the first full pay period on or after the date of decision. The Minister for Public Sector Administration concurred with the submissions of the Union and advised consent to the application including the proposed date of operation. I accept the submissions of the parties: the Award will be amended as sought and it will be made to commence from the first full pay period on or after the 11 March 1998. An Order is attached.
