REASONS FOR DECISION

This was an application made under Section 23(1) of the Industrial Relations Act 1984 (the Act) by the Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia (the Union) seeking a variation to the Plumbers Award (the Award).

The Union was seeking to delete the present Superannuation clause in the Award and replace it with a new revised Superannuation clause reflecting in the main variations made to the Federal Plumbers Award in recent times.

Eventually after an adjournment and negotiations between the Union, the Tasmanian Chamber of Commerce and Industry Limited and The Master Plumbers' Association of Tasmania, the Commission was presented with an agreed draft order.

The changes included recognition of the requirements of the current Commonwealth Law on superannuation, corrections, addition of the Construction and Building Unions Superannuation (C+BUSS) Scheme and the Quest Scheme as the Award prescribed funds plus provision for other agreed funds and specified dollar amounts changed to percentages.

A correction was also made so that the Superannuation clause provisions applied to both Divisions A and B of the Award whereas previously by mistake, it only applied to Division B.

The parties agreed that the proposed variations should operate from the first full pay period to commence on or after 18 February 1998.

The parties also submitted to the Commission that approval of the claimed variation was consistent with the Principles of the Commission and was not against the public interest.

Subject to any general changes to award superannuation provisions which may arise out of the forthcoming review of all the awards of the Commission, I accept the submissions of the parties and this application is approved and will be made to operate from the first full pay period to commence on or after 18 February 1998.
