Award variation - award interest - operative ffpp 18 February 1997 - wage rates - 2nd MRA - operative ffpp 20 March 1998 - consent matters - application granted REASONS FOR DECISION On 19 February 1998, an application was lodged with the Commission, pursuant to s.23 of the Industrial Relations Act 1984, by The Australasian Meat Industry Employees Union, Tasmanian Branch (the applicant), to vary the Meat Retailing Award (the award) by inserting the second Minimum Rate Adjustment. At the commencement of the hearing, on 20 March 1998, Mr Courtney, on behalf of the applicant, sought and was granted leave to amend the application to include a variation to Clause 6 - Award Interest, by inserting the names of a number of registered organisations that had been inadvertently excluded from the Order when the award was restructured, pursuant to the Structural Efficiency Principles, arising out of matter T6547 of 1996. Mr Courtney presented an agreed draft order (Exhibit C.1), with the operative effect as follows:
The parties presented submissions, in support of the amended application. They were of the view that the matters sought to be varied via this application were consistent with the Wage Fixing Principles and the public interest requirements of the Act. I support the submissions of the parties and the reasons they presented for varying the award. Therefore, I hereby determine the award be varied in the manner set out in the Order attached to this decision.
